This Anti-Spam Policy outlines prohibited activities regarding the use of ITLDC services and systems. It forms part of your agreement with ITLDC (ITL DIGITAL COMMUNICATIONS). This document is not exhaustive and may be updated at any time.
By using our services, you confirm that you have read and accepted these terms. If you do not agree, please refrain from using our services.
1. Zero Tolerance for Unsolicited Communications
ITLDC maintains a strict zero-tolerance policy (“No Spam”) for sending unsolicited communications, including but not limited to:
- Unsolicited bulk email (“spam”), regardless of whether it complies with regional laws.
- Unsolicited instant messages (“spim”).
- Spamming on internet forums, bulletin boards, classified sites, or any similar service.
- Spamming through personal services or social platforms.
Any use of opt-in or double opt-in mailing lists to promote ITLDC services is strictly prohibited unless explicitly authorized by ITLDC. If a recipient has not explicitly requested communication from you, you may not contact them on behalf of ITLDC.
Violating this policy will result in immediate termination of your account, forfeiture of unpaid commissions (if applicable), and further action as deemed necessary.
2. Responsibility and Indemnification
You are fully responsible for any use of our services in violation of this Anti-Spam Policy, whether by yourself or by any party using your account.
You agree to indemnify and hold harmless ITLDC, its affiliates, employees, contractors, and agents from any claims, damages, liabilities, or legal expenses resulting from your violation of this policy or related laws.
3. Audits and Compliance Monitoring
ITLDC reserves the right to audit user activities related to service use at any time, with or without notice. You agree to fully cooperate by providing requested documentation, including but not limited to:
- Email transmission logs
- Recipient lists
- Promotional content
- Time and date records
- IP addresses and server details
Failure to cooperate with an audit is grounds for immediate service suspension or termination.
4. Service Suspension and Liquidated Damages
Accounts found violating this Anti-Spam Policy will be immediately terminated at ITLDC’s sole discretion.
Where actual damages are difficult to calculate, you agree to pay ITLDC liquidated damages of five euros (EUR €5.00) for each unsolicited message transmitted. If actual damages can be reasonably calculated, you agree to pay the full amount.
For any breach of this policy not specifically outlined above, you agree to pay liquidated damages of EUR €500.00 per occurrence.
If legal action or collection efforts are necessary, you agree to reimburse ITLDC for all associated costs, including but not limited to attorney fees and court costs.
5. Hacked Accounts
If a customer’s server or account is compromised without their knowledge and used to send spam, this Anti-Spam Policy’s penalty clauses may not automatically apply. However, immediate corrective action is required, and continued negligence may result in account suspension or termination.
6. Reporting Violations
If you become aware of a violation of this Anti-Spam Policy, please report it to ITLDC with all relevant details. We take these reports seriously and investigate each in accordance with applicable laws and internal procedures.
